These Terms and Conditions form an integral part of all contracts, agreements, offers and other legal declarations concluded by HUBER with business partners (hereinafter referred to as the “Customer”) via distance selling. By entering into a business relationship with HUBER via distance selling, whether in writing, in person or by any other means, the Customer agrees to be bound by HUBER’s Terms and Conditions.
1.2 Contractual Partner
A Customer is any user of the online portals who submits an offer to purchase goods via the shop integrated into the platform. By using the online portals or by concluding a contract of sale for goods via them, the Customer becomes a direct contracting party.
Unless otherwise stated by HUBER during the purchase process, the customer’s contracting party is HUBER Digital GmbH, FN 552053v, Exerzierplatz 1, 6851 Mäder.
1.3 Conflicts
Any deviating terms and conditions of the customer or a third party shall only apply if HUBER has expressly agreed to their validity in writing.
1.4 Non-binding nature
By submitting an order, the customer makes a binding offer to purchase the selected products. HUBER is entitled to accept this offer within five working days. Acceptance takes place upon dispatch of the order confirmation.
2. Order requirements and process
2.1 Ordering process
By ordering goods, the customer submits an offer to conclude a contract of sale for the goods previously selected by the customer. In order for the offer to be accepted, the customer must provide all necessary details. These must be provided by the customer when placing their order. In particular, these include their first name and surname, a valid delivery address, payment details and a valid email address. The customer will receive an order confirmation, which constitutes acceptance of the offer.
2.2 Purchase price
Unless expressly stated otherwise, all amounts are amounts in euros and include statutory VAT, duties and transaction costs for payment processing. During the ordering process, the purchase price is to be understood as a single purchase price per product. Delivery costs are shown separately.
2.3 Vouchers, discount codes, promotions
Promotional vouchers issued as part of advertising campaigns, or gift vouchers purchased, may also be redeemed during the ordering process. The respective terms and conditions of the vouchers, discount codes and promotions apply. Promotional vouchers and gift vouchers are generally limited to use in the respective online shop. If goods are returned where the price reduction applies only as part of a quantity-based promotion, the customer is obliged to pay the additional amount (the price without the reduction) retrospectively. Unless otherwise expressly agreed, the customer may only redeem vouchers issued by Huber Digital GmbH in the online shop and may not redeem vouchers from other companies (including, therefore, vouchers from other HUBER group companies).
2.4 Payment
During the ordering process, the customer must select a payment method to settle the purchase price; they may choose to pay by credit card (Mastercard, Visa, American Express, Union Pay), Google Pay, Apple Pay, Bancontakt, eps, Klarna or PayPal. If the customer’s name and the credit card holder’s name differ, HUBER may reject the contractual offer within five days of the order being submitted, provided that no order confirmation and thus no acceptance has yet been issued, on these grounds alone. In any event, without prejudice to any further claims for damages, the customer is obliged to pay the full purchase price should the payment made by this third party be made fraudulently or fail to discharge the debt.
HUBER uses Shopify, a software programme provided by Shopify International Limited (hereinafter also ‘Shopify’), a company registered in Ireland, to process orders. To this end, a data processing agreement ( ) has been concluded between HUBER and Shopify . At the same time, other applications are used in the shop via Shopify. Further information on this can also be found in the privacy policy.
In order to offer customers the payment methods provided by Klarna and PayPal, the personal data provided by the customer during the checkout process (in particular, first name and surname, date of birth, a valid delivery address, payment method details and a valid email address) may be passed on to Klarna or PayPal in the form of contact and order details. The personal data transmitted is processed in accordance with the privacy policies of Klarna ( and PayPal (https://www.paypal.com/webapps/mpp/ua/privacy-full). When using the Klarna payment methods ‘Invoice’, ‘Instalments’ and ‘Instant Payment’, this is subject to a positive credit check. The following provisions apply in each case:
- Invoice: Payment due 30 days after dispatch of the goods
- Instalment plan: With Klarna’s financing service, the purchase is paid for in fixed or flexible monthly instalments in accordance with the terms specified at checkout.
- Instant bank transfer: The customer’s account is debited once the order has been placed,
In this regard, HUBER forwards the customer’s details to Klarna as part of the ordering process. The aforementioned payment methods can only be offered subject to a positive credit check.
2.5 Terms of delivery
Purchased goods will be delivered to the address the customer has specified as the delivery address in the order. The goods ordered are delivered by professional delivery services. The customer is informed of the delivery costs to be paid before completing the order process; these are then also shown separately in the order confirmation, order receipt or delivery note/invoice. The delivery costs are always displayed before the order is finalised.
The delivery dates stated during the ordering process are, in principle, non-binding and – unless explicitly agreed otherwise in writing – do not form part of the contract.
If, due to force majeure (e.g. strikes, natural disasters) or other circumstances beyond our control, it is not possible to meet any agreed delivery or performance deadline, the customer will be informed of the expected delay. Any agreed delivery or performance deadline shall be extended by the duration of such an event.
2.6 Product information
Product images are for illustrative purposes only and may differ visually from the actual product.
HUBER uses automated processes and artificial intelligence to create or improve content and multimedia content (in particular product images, illustrations and texts). Where artificial intelligence is used and this is not obvious, HUBER undertakes to provide information regarding the use of artificial intelligence.
These are intended to represent our products as accurately as possible. In individual cases, images (e.g. background or colour representation) may differ from the actual product.
2.7 Retention of title
The goods remain the property of HUBER until the purchase price has been paid in full.
3. Right of withdrawal and cancellation
3.1 Specific rights of withdrawal for customers
If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), they are entitled to the rights of withdrawal set out in Sections 3 and 3a of the KSchG, as well as under the Distance and Off-Premises Sales Act (FAGG). The customer may withdraw from a sales contract within 14 days without giving any reason.
- The withdrawal period is fourteen days from the day on which the customer, or a third party designated by the customer (other than the carrier), took possession of the goods.
- If the customer has purchased the goods as part of a single order and these goods are delivered separately, the withdrawal period begins on the day on which the customer, or a third party designated by the customer (other than the carrier), takes possession of the last item.
3.2 Exclusion of the right of withdrawal
The customer has no right of withdrawal in the case of
- goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, provided that the seal has been broken after delivery
3.3 Form of the notice of withdrawal
To exercise the right of withdrawal, the customer must inform Huber DIGITAL GmbH, Hauptstraße 17, 6840 Götzis, of their decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). The notice of withdrawal is not subject to any specific form. The customer may use the model withdrawal form for this purpose. The withdrawal period is deemed to have been observed if the notice of withdrawal is dispatched within the time limit.
3.4 Consequences of withdrawal – refund
If the customer withdraws from the contract, all payments made by the customer, including delivery costs where applicable, must be refunded without delay. If the customer has expressly opted for a method of delivery other than the cheapest standard delivery offered, they are not entitled to a refund of the additional costs incurred as a result.
Refunds may be withheld until either the goods have been received or the customer has provided proof of their return.
Any refunds will be made using the same method the customer originally used to pay.
3.5 The consumer’s obligations upon withdrawal – return of goods
If the customer withdraws from a sales contract, they must return the goods received without undue delay, but no later than 14 days from the date of submitting the notice of withdrawal. The return period is deemed to have been met if the goods are dispatched within that period. The direct costs of returning the goods are to be borne by the customer. These are generally listed on the website under ‘Delivery & Returns’.
The customer must pay compensation for any reduction in the market value of the goods if this loss in value is attributable to handling of the goods that goes beyond what is necessary to assess their nature, characteristics and functioning . This may, in particular, also be the case if the goods are worn (beyond mere testing) or washed; in such cases, compensation amounting to the value of the goods may also be required.
Goods sent to HUBER in error will be retained for two months and, unless the sender comes forward, will be destroyed without compensation. HUBER is entitled to reimbursement of expenses (storage costs, search costs, etc.) incurred in connection with goods sent to HUBER in error, whether intentionally or accidentally.
4. Statutory warranty and liability for defects
If the purchased goods are defective, the customer is entitled to statutory warranty claims. Warranty claims must be brought before a court within 2 years. In accordance with Section 932 of the Austrian Civil Code (ABGB), the customer is entitled to rectification, replacement, a price reduction or rescission of the contract; however, the customer may initially only demand rectification or replacement of the goods, unless such rectification or replacement is impossible or would involve a disproportionately high cost for HUBER. In such cases, the customer is entitled to a price reduction or, provided the defect is not minor, to rescission of the contract. The customer must submit the notice of defect directly to HUBER, together with the goods in question.
If a price reduction has already been granted on account of damage to or defects in the goods, any claim based on this is excluded.
5. Exclusion of liability
5.1 No liability for the accuracy of third-party information and for indirect damages
HUBER accepts no liability for the accuracy and completeness of information provided to it by third parties, insofar as its inaccuracy or incompleteness is not expressly known (Section 1300 of the Austrian Civil Code (ABGB)). Furthermore, HUBER shall not be liable for indirect damage, consequential damage, loss of profit, pure financial loss, loss of interest and damage arising from claims by or against third parties who are not contracting parties.
5.2 No liability in cases of slight negligence
If the customer is a consumer, the statutory provisions on damages shall apply. If the customer is a business, HUBER’s liability, irrespective of the legal basis, shall be limited to cases of wilful misconduct and gross negligence.
Excluded from this general limitation of liability are damages resulting from injury to life, limb or health, or claims under the Product Liability Act.
5.3 Limitation of liability in terms of amount
Where the customer is a business, any claims for damages against HUBER shall in any event be limited to compensation for reasonable and foreseeable loss, and in any case shall not exceed the purchase price.
5.4 No liability for prices
HUBER accepts no liability, guarantee or warranty that there are no comparable, cheaper products available on the market.
5.5 No liability for third parties
HUBER shall only be liable for damage caused to customers who are business customers by third parties engaged by HUBER in the event of negligence in the selection of such third parties. If the customer is a consumer, HUBER shall be liable for its vicarious agents in accordance with the statutory provisions.
5.6 No liability for information or content provided by third parties
HUBER shall not be liable for any damage arising from the fact that a recommendation, advice or similar from a third party (influencer, cooperation partner, etc.) has been followed, provided that such third party is not a vicarious agent of HUBER and/or HUBER cannot be held at fault. This also applies where HUBER reproduces third-party content on its own website, as well as to product reviews of HUBER products.
6. Limitation period/preclusion of claims
If the customer is a business, all claims against HUBER shall lapse if they have not been asserted in court or expressly acknowledged in writing within one year of the claimant becoming aware of the damage and the party responsible for it, or of the event giving rise to the claim . For consumers, the statutory limitation period applies.
7. Data protection and cookies
HUBER processes the customer’s personal data in accordance with the Privacy Policy and all relevant legal provisions.
In addition, HUBER uses cookies to personalise the customer’s visit to its online portals and to improve user-friendliness. Further information can be found in the privacy policy.

9. Due Date, Interest on Late Payments, Prohibition on Set-off
9.1 Due date
Invoices are generally due for payment immediately upon receipt, without any deductions (see ‘Payment’ for further details). If the purchase price has not already been paid directly as part of the ordering process, or if no advance payment has been made, the purchase price must be transferred to the bank account specified on the invoice upon receipt of the invoice.
9.2 Interest on late payments, reminder fees
In the event of late payment, HUBER is entitled to charge interest on arrears to the extent permitted by law, as well as reasonable debt collection costs, insofar as these are necessary.
9.3 Prohibition on set-off
The customer is not entitled to set off their own counter-claims against claims by HUBER. Exceptions to this are counter-claims by consumers in the event of HUBER’s insolvency, or if their counter-claim is legally related to HUBER’s liability, or if it has been established by a court or acknowledged by HUBER.
10. Provisions concerning the website
10.1 Prohibition of reproduction
The content and structure of the online portals are protected by copyright. The reproduction of information or data, in particular the use of texts, parts of texts or images, is generally not permitted and requires the prior written consent of HUBER.

The European Commission provides a platform for online dispute resolution (ODR), which can be found at www.ec.europa.eu/consumers/odr/. There is no obligation to participate in dispute resolution proceedings before a consumer arbitration body.
11.2 Severability clause
Should any provision or provisions of these General Terms and Conditions be or become (legally) invalid or unenforceable, this shall not affect the validity of the remaining provisions of these General Terms and Conditions.
11.3 Place of performance and jurisdiction
Götzis, Austria, is hereby agreed as the place of performance for all obligations arising from contracts concluded with HUBER. Insofar as there is no mandatory place of jurisdiction for the client, for example within the meaning of Section 14 of the Austrian Consumer Protection Act (KSchG), the exclusive jurisdiction of the court in Götzis, Austria, with subject-matter jurisdiction over the matter, is agreed for all disputes arising from or in connection with the business relationship between the client and HUBER (Section 104 of the Austrian Code of Civil Procedure (JN)).
